Virginia Employment Law successfully resolved a federal lawsuit against the Virginia Military Institute’s Board of Visitors through private mediation in the U.S. District Court for the Western District of Virginia. The case involved a prospective student, identified as Jane Doe, who alleged she was sexually assaulted by a cadet during an overnight campus visit in September 2021.

The complaint, filed in September 2023, asserted that VMI’s subsequent investigation into the assault failed to follow proper Title IX procedures and wrongfully deemed the allegations “unfounded.” The suit sought accountability for institutional shortcomings in responding to sexual misconduct claims.

On November 19, 2024, the parties reached a confidential settlement “upon mutually agreeable terms,” ending the litigation. The resolution reflects Virginia Employment Law’s continued commitment to advocating for survivors of sexual assault and ensuring that educational institutions comply with their legal obligations to protect students and prospective students under Title IX.
